Erika Kirk Fights Tyler Robinson Defense’s Bid to Delay Murder Trial Until 2029

A battle is emerging over the date for the Charlie Kirk murder trial.

Accused assassin Tyler Robinson’s lawyers are pushing to delay the trial for years — until 2029.

Since the prosecution is seeking the death penalty, Robinson’s legal team claim that they need multiple years to prepare.

On the other hand, prosecutors say they will be ready in one year’s time and have proposed January 2028 as a trial date.

Erika Kirk is asking the court to reject the defense’s ridiculous request and schedule a speedy trial.

Here are the details:

Robinson’s lawyers want to push the trial to the third quarter of 2029, four years after Charlie was m*rdered. Erika’s motion calls that “grossly out of line with comparable cases”

SWIFT JUSTICE.

Robinson was arrested last year after turning himself in, in connection with the assassination of Charlie Kirk. He finally entered a plea of not guilty last month.

Both sides expect the actual trial to take months. Prosecutors have said they’d be ready in fall of next year, but they also suggested waiting until after the holidays to get started, proposing January 2028.

I’ll be in Provo tomorrow for the next hearing. There will be no video, audio or livestream.

On Friday, a hearing was held in Utah on the timeline of the trial.

Footage of Tyler Robinson arriving at the hearing in an armored vehicle was shared online:

UST IN: A truck believed to be carrying Tyler Robinson arrives at a Utah courthouse ahead of a high-stakes hearing over the timeline of his trial in the killing of Charlie Kirk.

The arrival comes after Robinson’s defense team requested a 2029 trial date, a proposed delay that Erika Kirk has sharply criticized.

Now, the court is set to address when the trial should begin, with the defense and prosecutors proposing different timelines.

During the hearing, both sides submitted their requests for the trial date.

However, Judge Graf was unable to reach a decision and said he needed more time to make a ruling.

ABC News has more:

The judge in suspect Tyler Robinson’s case was expected to set a timeline for the capital murder case, including trial dates, during a hearing on Friday. However, Judge Tony Graf did not set a trial date and scheduled the next hearing for Nov. 9, The Associated Press reported.

The defense has asked that the capital trial start in the third quarter of 2029, arguing in a memo filed Wednesday that that timeline is consistent with other capital cases in the state. The defense anticipated that the trial could take six to seven months and would require “substantial time” for jury selection. The defense also noted they plan to undertake a venue study and, depending on the results, may request a change of venue for the trial.

In the state’s own filing, prosecutors said they anticipate the trial lasting 17 weeks and that they could be ready to start as soon as Oct. 4, 2027. However, the state recommended that the trial begin on Jan. 31, 2028, to avoid the “worst of the winter season” as well as the Thanksgiving and Christmas holidays.

In response to both filings, Kirk’s widow, Erika Kirk, asked the court to “enforce the right to a speedy disposition” and set the trial for as early as possible in 2027, no later than the state’s anticipated readiness date of Oct. 4, 2027, to avoid “needless delay.”

“Under the Defendants’ proposed schedule, Mr. Kirk’s two children, who were one and three at the time he was murdered, will be six and eight years old by the time the trial concludes,” a motion filed on Erika Kirk’s behalf Thursday stated. “They will face the uncertainty of this criminal proceeding longer than they had their father in their lives. Each hearing induces anxiety, pain, and mourning. The Kirk family deserves to have this matter resolved expeditiously.”

The motion also argued that a 2029 trial start will come at a “great cost to the taxpayers of Utah.”
