Voters in Virginia within days are being asked to vote on a plan that would provide special protections for same-sex “marriage” should the national mandate, which was described by Supreme Court justices as being unconnected to the Constitution, ever be overturned.

There has been developing for some years already the impetus to overturn the Obergefell v. Hodges ruling that created, literally out of nothing but the political wishes of several leftist justices, that status for the entire nation.

Should that be taken down by a future opinion, state constitutional requirements would come into play and it is for that reason leftists now are trying to change the state constitution in Virginia: Because it still has a provision banning same-sex marriage.

A report at the Washington Stand explains that is the crux of the battle, but the reason it is now being brought into court is because activists were unable to follow the requirements of the constitution in their agenda to change it.

An action by the Founding Freedoms Law Center has been brought in court in Prince William County on behalf of Pastor Ben Purves of Occoquan Bible Church in Woodbridge, Va.

🚨
A RARE MOVE by a Virginia Bishop Ahead of Election Day “Catholic Bishop Michael Burbidge says he has never before asked every priest in his diocese to do what he requested this weekend: read a letter at Mass urging Catholics to oppose two Virginia constitutional amendments on abortion and marriage.” “Across 70 parishes serving more than 430,000 Catholics in Northern Virginia, worshippers heard Burbidge warn against what he called ‘two dangerous ballot initiatives’—proposed constitutional amendments that Virginians will decide Nov. 3. Early voting begins Friday.” “The effort follows a joint statement Burbidge issued with Richmond Bishop Barry Knestout in August. In his latest letter, Burbidge urged parishioners to pledge to vote at https://t.co/kJzKhv4RZd, cast ballots early beginning Friday, and encourage their family, friends, and colleagues to oppose the amendments.” … MORE:

The lawyers explain their fight doesn’t address the faulty reasoning for the attempted change.

It does, however, “concern[] whether the Proposed Amendment was brought forward to the November 2026 ballot through the process that the Constitution of Virginia requires. It was not. The Proposed Amendment reached the ballot through a process that departed from the mandatory requirements of Article XII, § 1 of the Constitution of Virginia through Virginia Code § 30-13.”

The legal filing continues, “Virginia Code § 30-13 requires the Clerk of the House of Delegates to have published and distributed copies of a proposed amendment to the clerks of Virginia’s circuit courts, and requires each circuit court clerk to post a copy ‘at the front door of the courthouse’ and make a second copy ‘available for public inspection,’ no later than three months before the intervening general election of members of the House of Delegates. These steps exist to inform the voters before the pivotal House of Delegates election. They were not performed before the November 4, 2025 general election by the Clerk of the House of Delegates or the Circuit Court Clerk or any other Virginia circuit court.”

The Washington Stand explained Purves said pastors are responsible for proclaiming biblical truth, even on polarizing subjects.

“It’s my hope that pastors will become more bold in proclaiming the gospel and the truth of God’s word, and not letting it be restricted to the church building or to church members’ homes. We really need to amplify truth in the public square, and if we do not, we will find it increasingly anti-Christian,” Purves said.

Already, some 400 pastors have signed a letter Purves helped assemble asking Virginians to reject the change that turns the state constitution into a promotion for the LGBT lifestyle choice.

“God created the institution of marriage as a lifelong covenant between a man and a woman which is to be a portrait of Christ’s love for the church (Eph 5:32). Instead of defacing marriage, we must honor it (Heb 13:4),” the letter said.
