Democratic Socialists Of America Members Could Potentially Be Blocked From Being Sworn Into Congress, House Republican Suggests

Members of the Democratic Socialists of America (DSA) elected to Congress could be blocked from taking their oath and being sworn in as members of the House of Representatives because of a little-known congressional maneuver.

According to Fox News, some conservatives contend that any member-elect can challenge another member-elect’s right to be sworn in if they provide evidence that the individual would not uphold their oath.

The DSA’s political platform, which calls for replacing the current Constitution with a new governing document, is the heart of the dispute.

Rep. Keith Self (R-TX) suggested to the outlet that he may invoke the maneuver.

“You cannot swear an oath to support and defend the Constitution while actively working to destroy it. The oath of office is not just words you say at a ceremony. It is a belief. It is an oath to our country and our fellow countrymen,” Self told Fox News Digital.

“The House has both the authority and the duty to ensure that anyone who takes that oath does so in good faith, without mental reservation or purpose of evasion. As DSA candidates and the Red-Green Alliance gain ground, we must enforce the Constitution as written or risk allowing people committed to replacing it to take seats of power under false pretenses,” he added.

“Rep. Keith Self, R-Texas, told Fox News Digital he’s considering invoking the challenge. Rep. Tim Burchett, R-Tenn., has already said he plans to use it against incoming Rep. Darializa Avila Chevalier. The move would face serious legal headwinds — the Supreme Court ruled in 1969 that the House cannot exclude an elected member who meets constitutional age, residency, and citizenship requirements,” Fox News wrote.

Republican lawmakers are eyeing a little-known congressional maneuver that could block Democratic Socialists of America members from being sworn into the House — even if they win their elections next week.

Fox News shared further:

The “Red-Green Alliance” is a term used on the right to describe cooperation between far-left groups and radical Islamic organizations or operators.

“Anyone who has personally embraced the destruction of the Constitution has no business being sworn in to uphold it,” Self said.

According to an analysis by the Center for Renewing America, a challenge to a member-elect’s fitness to take the oath of office can be followed by the House speaker asking them to step aside while the debate begins.

“The objecting member should place the documentary record before the House, and the House should debate whether that evidence establishes that the member-elect remains committed to destroying the constitutional order,” the group’s analysis said.

The House would then vote on a resolution that “establishes the member-elect’s commitment to destroying the constitutional order,” which, if passed, could stop them from being sworn in.

The theory relies on a number of variables. For example, if House Minority Leader Hakeem Jeffries, D-N.Y., is elected speaker, he could decide to dismiss the challenge altogether. Speaker Mike Johnson, R-La., could do the same if he so chooses if Republicans keep their majority.

Meanwhile, Self co-sponsored legislation requiring all American judges to be natural-born citizens.

“I just cosponsored the Judicial Loyalty Act to require ALL American judges to be natural-born citizens. This is a commonsense safeguard to protect the Constitution from foreign influence and ensure those who interpret our laws have undivided loyalty to the United States,” Self said.

“Radical judicial activism must be stopped. Every member of Congress should join me in supporting
@RepPeteStauber’s bill,” he added.

Recently, federal authorities stopped an alleged plot to kill the Texas congressman.

CBS News has more:

Federal authorities are not releasing details of the alleged plot.

But what we know about the arrest has raised safety concerns among some within the North Texas congressional delegation.

Being on the campaign trail every day this time of year is a necessity for the nine North Texas members of the U.S. House of Representatives seeking reelection, including Texas Republican U.S. Rep. Beth Van Duyne.

But news that a 17-year-old from McKinney has been arrested for plotting to kill Congressman Keith Self during a campaign event this month has Van Duyne more security-conscious than ever.

“I don’t discuss publicly what we do with security,” Van Duyne said. “I can tell you that we definitely have enhanced it. We’ve been enhancing it for months because there are legitimate threats that are out there

CBS News Texas asked Van Duyne what she knew about the arrest of a 17-year-old, whom she says may have been radicalized by conservative opposition to political issues involving Muslims.

Self recently publicly criticized plans to expand a McKinney mosque.

“I understand he was inspired by ISIS, but as far as further details on that, they’re still investigating, and they’re hesitant to release anything until they know more,” Van Duyne said.
