This is a crazy story.
An Arizona man convicted of manslaughter has just had his sentence tossed out.
And, the reason why is absolutely bonkers.
54-year-old Gabriel Horcasitas was originally sentenced to 10 1/2 years behind bars for the 2021 road rage shooting of Christopher Pelkey.
Just before the Horcasitas’ first sentencing, the victim’s family played an AI-generated video of Christopher Pelkey delivering a message to his killer and forgiving him.
For reference, here’s the video that was played in court:
Now, you might be wondering: how on earth was this allowed in court?
Is it not incredibly disturbing to use AI to recreate the image and voice of a road rage victim, then use that depiction to give a statement in their own court trial?
It sounds dystopian — like something straight out of an episode of Black Mirror.
But apparently, the judge saw otherwise.
In face, he was so touched by the AI video that he slapped on an even harsher sentence than prosecutors asked for!
The New York Post noted:
However, that sentence did not hold up very well in appeals court.
On Wednesday, the Arizona Court of Appeals threw out Horcasitas’ sentence.
The court called the AI video “not reliable” and said that the judge gave him a “fundamentally unfair” sentence.
Reuters reported further:
Now, Horcasitas will face re-sentencing sometime in the near future.
At this time, his re sentencing date has not yet been scheduled.
What do you think?
Was the appeals court’s decision fair?
