The Bible is not a book that happens to contain laws. It is a law book – the world’s foundational law book. Law originates in God, who speaks it into existence before man exists to write it down. The Bible is the testimony to that law – and because it is a written, binding record of a transcendent lawgiver, it has generated every lasting major legal tradition in Western civilization, which, because of its exclusive capability to justly and comprehensively regulate the affairs of man, rules the world. I offer the proof of this contention in the form of a nine-point legal brief.
I. Law Begins Before Man
The first law is not given to Israel. It is spoken into existence. Genesis 1 is not poetry about origins – it is the establishment of order. “And God said … and it was so.” The universe operates by decree. Matter behaves. Forces hold.
Jeremiah 33:25 makes this explicit: “If I have not established my covenant with day and night … then I will reject the descendants of Jacob.” The regularity of creation is itself a covenant – a binding legal arrangement between God and the cosmos. Natural law is not a human invention but the first legislation.
II. Natural Law: The Law Written on the Heart
Romans 2:14-15 establishes the second tier: “When Gentiles, who do not have the law, do by nature things required by the law, they are a law for themselves … they show that the requirements of the law are written on their hearts, their consciences also bearing witness.”
This is the foundation of natural law theory – the idea that moral law is accessible to all people regardless of revelation. Aquinas built on it. The American founders invoked it. But the origin is the Bible.
III. Covenant: The Legal Architecture
The Bible’s central organizing structure is the covenant – and covenant is a legal instrument. The Abrahamic covenant in Genesis 15 follows the form of an ancient Near Eastern suzerain-vassal treaty: the cutting of animals, the passing between the pieces, the binding oath. The Mosaic covenant at Sinai in Exodus 19-24 is a full treaty document: preamble, historical prologue, stipulations, witnesses, sanctions and succession arrangements. It is the actual legal form of the ancient world, and the Bible uses it with precision. The covenant is the prototype of every contract, treaty and constitutional arrangement that followed.
IV. Case Law: The Casuistic and Apodictic Forms
Exodus 21-23 is not just a list of rules but case law. It introduced the apodictic and casuistic distinctions that legal scholars still use: Casuistic: If a man strikes his servant … then …” Apodictic: “You shall”/”shall not.” The Bible pioneered the method of reasoning from specific cases to general principles – the foundation of common law.
V. Constitutionalism: Deuteronomy
Deuteronomy is a national constitution. It establishes the office of king with explicit limits (Deuteronomy 17:14-20), creates a judicial system with judges and officers (Deuteronomy 16:18) and sets the terms of national succession. It is a charter of government – written, binding and supreme.
VI. The Full Legal System
From there, the Bible contains:
• Criminal law: distinctions between homicide and manslaughter, theft, assault (Exodus 21-22)
• Property law: the Eighth Commandment, the Jubilee system of land tenure (Leviticus 25)
• Contract law: binding vows and oaths (Leviticus 27, Numbers 30)
• Family law: marriage, divorce, inheritance (Exodus 20:12, Deuteronomy 24)
• Labor law: timely wages, the unmuzzled ox (Deuteronomy 24:14-15, 25:4)
• Due process: two or three witnesses, presumption of innocence, judicial impartiality (Deuteronomy 17:6, 19:15, 25:1)
• Equity: “Do not show partiality to a poor man in his dispute” (Exodus 23:3)
• International law: rules of warfare that predate the Geneva Conventions by millennia (Deuteronomy 20)
VII. Law Codes that Predate Moses
The only written legal codes that predate Moses are Mesopotamian: Ur-Nammu, Lipit-Ishtar, Eshnunna and Hammurabi. They are real achievements deserving respect, but they are not law in the biblical or germinal sense, and they did not produce lasting systems.
They are instead royal decrees. Each presents itself as a gift from a patron deity to a king, and the king remains above the law. The law binds subjects; it does not bind the sovereign. That is the opposite of the biblical structure, where Deuteronomy 17 commands the king to write out a copy of the law and read it all his days. No Mesopotamian code places the ruler under the law.
They are also casuistic lists, not constitutions. They record specific cases and penalties without a transcendent moral framework, without covenant and without a written charter above the ruler. They are mere administrative records of royal justice, not the expression of a moral order.
Further, the published order is not controlling. God’s law was already spoken, known and binding before Moses wrote it down – from the decrees of creation and the sanctions given to Noah, to Abraham who “kept my commandments, my statutes, and my laws” (Genesis 26:5), and to Israel keeping Sabbath and judging by God’s statutes before Sinai.
VIII. Christ, the Perfect Law
The New Testament does not repeal the Mosiac code, it fulfills it. Jesus is the perfect law – the Lawgiver in the flesh. “Think not that I am come to destroy the law, or the prophets: I am not come to destroy, but to fulfil” (Matthew 5:17). In the Sermon on the Mount, He elevates the standard: murder is traced to anger, adultery to lust, and love past outward compliance into the heart. Christians are new creatures in Christ, and the Holy Spirit dwells in them, training believers to recognize the spirit within the law and apply it justly and intelligently.
And, importantly, the New Covenant does not replace the Abrahamic Covenant for those of the House of Judah who decline to accept the upgrade (Galatians 3:17-29, Romans 11:29) prior to its finalization in the Millennial Kingdom.
IX. The Summation
My claim is not that the Bible is the only source of rules and statutes operating in the world today or that every nation specifically accepts its authority, or that laws have not been corrupted by evil men and governments, but that, in the overarching practical outworking of order and justice in the world, every key legal doctrine derives ultimately from the Lawgiver and His Word. That is manifestly true even in the departures from the legal norms.
