President Trump’s push to reign in the Deep State just got a massive boost.
The Supreme Court REFUSED to hear arguments from a Biden-appointee who was given the boot by President Trump.
Gwynne Wilcox wanted the Supreme Court to side against a lower court ruling that agreed with the President’s assertion that says the Executive – The President – of the Executive Branch
CAN actually fire federal appointees.
That sounds like a very Executive action, if you ask me.
But common sense is definitely a rare commodity when it comes to Biden-appointees to begin with.
Yesterday, the Supreme Court actually took the common sense approach:
The US Supreme Court closed the book on former National Labor Relations Board member Gwynne Wilcox’s quest to reverse her termination at the hands of President Donald Trump.

The high court’s unwillingness to alter the previous ruling essentially adds one more nail in the coffin of the Deep State.
That untouchable status they’ve enjoyed for so long is eroding fast.
Wilcox wasn’t happy about the ruling, which in effect validated President Trump’s proper use of Executive Authority when he fired her, as reported by the
Associated Press:
The US Supreme Court declined on Monday to hear a bid by a Democratic-appointed member of the National Labor Relations Board to challenge the legality of her firing by President Donald Trump.
The justices turned away former NLRB member Gwynne Wilcox’s appeal of a lower court’s ruling that said the Republican president’s January 2025 firing of her was a valid exercise of executive authority.
Trump’s move to oust Wilcox from the NLRB was part of his shakeup and downsizing of the US government, including firing thousands of workers, dismantling federal agencies, installing loyalists in key jobs and purging career officials.
“I’m disappointed that the Supreme Court has declined to hear this case, not only for myself, but also for the workers and employers who rely on the National Labor Relations Board to resolve labor disputes impartially and free from political pressure,” Wilcox said in a statement.
Wilcox added that she would remain committed to “protecting the principles that allow the board to serve the public fairly.”
Wilcox, the first Black woman to serve on the agency’s board, was appointed to a second five-year term in 2023 by Democratic former President Joe Biden. Trump moved to fire her about a week into his second presidential term, drawing a lawsuit by Wilcox.
That decision comes just a few months after another big decision by the Supreme Court along the same lines.
The 91-year-old case of Humphrey’s Executor v. United States was long considered the gold standard used for limiting Presidential power for firing within federal agencies.
Check out this Fox News clip from just a few months ago when the 6-3 ruling came down that ‘OVERRULED’ that 1935 decision:
MASSIVE WIN: The Supreme Court rules 6-3 that President Trump has the constitutional power to fire federal bureaucrats, clearing the way for him to move forward with the removal of Federal Trade Commissioner Rebecca Slaughter (a Democrat appointee).

Here’s the full text of that post detailing the ‘Humphrey’s Executor’ decision a few months ago, for easier reading:
MASSIVE WIN: The Supreme Court rules 6-3 that President Trump has the constitutional power to fire federal bureaucrats, clearing the way for him to move forward with the removal of Federal Trade Commissioner Rebecca Slaughter (a Democrat appointee).
The Hill: “It formally overturns the high court’s 1935 landmark decision, Humphrey’s Executor v. United States, which laid the groundwork for certain agencies across the executive branch to enjoy a degree of independence from the White House.”
“If anything more is left of Humphrey’s, we overrule it,” Chief Justice John Roberts wrote for the majority opinion.
If you really want a taste of how ridiculous — lacking all common sense — the arguments put forward to limit the President’s ability to fire federal appointees really are, check this out.
Listen to this short audio of Justice Gorsuch personally pointing out the absurdity of the thing as he directly questioned the lawyer for the FTC Commissioner fired by President Trump in that previous case:
Must Listen: Justice Gorsuch questions the attorney for fired FTC Commissioner Rebecca Slaughter on basic executive functions:
Justice Gorsuch: “So even some quintessentially executive functions, in your view, are not vested in the president of the United States?”

Part of the Deep State’s tenacity in maintaining a bureaucratic foothold regardless of elections has relied on the legal ability to sit outside the reach of the Executive in the White House.
But that ‘untouchable’ status I mentioned earlier was just ripped off by yesterday’s SCOTUS decision, according to this report from the
IPP (Idaho Public Press) published on msn.com:
The decision matters because it effectively locks in a ruling that Congress overstepped by limiting the president’s power to fire NLRB members.
This was not a ruling on the merits. The Supreme Court simply refused to take up the case, which means a federal appeals court decision stays in force. That ruling held that Congress violated the Constitution by restricting the president’s ability to remove NLRB members.
By declining review, the justices left the appeals-court ruling in place. Bloomberg characterized the move as a rebuff of the fired member and a win for Trump’s broader effort to assert White House control over federal agencies.
At stake is a long-running constitutional question: can Congress limit a president’s ability to remove leaders of agencies that exercise significant regulatory power? Congress, by statute, has protected members of bodies like the NLRB from removal except for cause — a design that supporters of such protections argue is meant to insulate independent agencies from day-to-day politics.
The Trump administration has argued the opposite: that the Constitution’s grant of executive power gives the president authority to remove officials who wield executive power, including members of multi-member boards. The appeals court ruling that the Supreme Court left in place embraced that view, finding the removal restrictions unconstitutional. (Emphasis added.)
That basic argument that the President sits atop the ‘executive’ hierarchy now stands as the status-quo.
The Deep State’s ability to simply outlast the duly elected political choice of the people… is GONE — at least as far as this specific limit on the Presidency goes.
My question is what about those like the Governor of Massachusetts, who insists she has the authority to use HER ‘executive power’ to overrule President Trump’s ‘executive power’ in order to PROTECT ILLEGALS?:
Massachusetts Governor says she will use ‘executive power’ to stop Trump from deporting criminal aliens
“We want to protect our residents.”

Keep in mind, that clip aired on MSNBC less than 24 hours after President Trump’s November 2024 election victory.
Already, the decision was being made far and wide to undercut his authority — EVEN BEFORE HE HAD IT TO WIELD!
That same thinking hasn’t gone away.
Not even the Supreme Court has the ability to do away with that level of TDS completely.
With the midterms upon us, the stakes are even higher.
Democrats and the sudden upsurge of ‘Democratic Socialists’ would like nothing more than to reverse everything President Trump has accomplished to date.
Given a chance, there’s every reason to expect that every person President Trump fired would be welcomed right back into the federal fold with open arms, and probably backpay to boot.
The Supreme Court’s decision NOT to make a decision in this instance is a solid step towards making sure that doesn’t happen.
But elections have consequences, and the battle is far from over.
