A federal judge just dealt a major blow to President Trump’s efforts to crack down on birth tourism.
In a ridiculous (but not surprising) ruling, Biden-appointed U.S. District Judge Deborah Boardman issued a preliminary injunction blocking President Trump’s executive order — at least temporarily.
This is a reversal of Judge Boardman’s earlier decision refusing to put the block in place.
Here are the details:

UPDATE: The same federal judge who declined to block Trump’s revised birthright-citizenship order last week has now halted it after challengers amended their lawsuit.
Judge Deborah Boardman barred the administration from enforcing the new restrictions while the case proceeds.
The revised order targets citizenship for children born in the U.S. to certain foreign officials, designated enemy nationals and people accused of using birth tourism.
After the Supreme Court ruled against President Trump’s original executive order restricting birthright citizenship back in June, he issued two new ones.
One of these new executive orders specifically targets birth tourism, where a foreign woman travels to the United States to give birth for the sole purpose of securing citizenship for her child.
Last week, Judge Boardman denied a similar request to block the birth tourism executive order from going into effect. But, this was because the plaintiffs did not mention the new executive orders in their request.
Now that the filing has been modified, she has granted the request.
CBS News reported further:
Since returning to office last year, President Trump has sought to eliminate or narrow birthright citizenship. After the Supreme Court in June struck down his initial attempt to end birthright citizenship, he signed a narrower order last month to deny citizenship to children of “alien enemies,” foreign government employees and people allegedly engaged in “birth tourism.”
On Wednesday, U.S. District Judge Deborah Boardman temporarily halted the Trump administration from enforcing the new order, too. She found a group of people who sued are likely to succeed in showing the order violates their rights under the 14th Amendment to the Constitution, which grants citizenship to “all persons born or naturalized in the United States, and subject to the jurisdiction thereof.”
Boardman did not extensively analyze the specific exceptions to birthright citizenship laid out in the Trump administration’s order, instead pointing to the Supreme Court’s earlier ruling, calling it “the law of the land.”
“The 2026 Executive Order is almost certainly unconstitutional as applied to the certified class for the simple reason that the Supreme Court in Barbara already decided that the children in the class are citizens at birth,” she said. “This Court must, once again, preliminarily enjoin enforcement of the President’s most recent attempt to strip the right to citizenship from them.”
This is just the latest example of the ongoing, left-wing judicial coup against the Trump administration.
In a
Fox News appearance, Attorney General Todd Blanche explained that this new executive order was specifically crafted to follow the Supreme Court’s June ruling.
He is promising to appeal the absurd decision, and take it all the way to SCOTUS if he needs to!
