The Department of Justice just a day ago warned California officials they needed to address the presence of thousands of noncitizens on their voter rolls, as those individuals legally are not allowed to participate in elections.
The federal department said ballots received from those people need to be segregated until it is determined whether their vote should be counted.
California refused, and now there’s a court case.
A report from RedState said the DOJ has gone to court against the state because of its refusal to address the possibility of illegal votes.
The case, in federal court in the Central District of California, calls for California to stop counting ballots from those identified in a federal database as “likely noncitizen” voters.
California’s practice is to count every ballot whether it’s from a legal voter or not.
Attorney General Todd Blanche announced the DOJ’s action Thursday, explained the DOJ “provided California an opportunity to self correct its records and we requested that it segregate the suspected illegal ballots for the upcoming election. California has refused to comply and intends to facilitate noncitizens in voting, which is a violation of federal law.”
That means, he said, “Today we filed an emergency court action against California seeking to ensure that noncitizens who received ballots in California do NOT vote in the upcoming election. Election integrity is a top priority for Americans and the Justice Department.”
While the DOJ’s request was only for those votes to not be counted until the individual’s citizenship was verified, Secretary of State Shirley Weber refused.
In fact, it is federal law that bars noncitizens from voting in federal elections.
WND had reported when the warning letter went out, along with a password-protected thumb drive the DOJ has identified as people “it believes are likely noncitizens ‘who were sent a vote-by-mail ballot from California to participate in the November 2026 federal election.'”
California has been on notice about the problem for months. Homeland Security Secretary Markwayne Mullin first contacted Weber on July 16 about suspected noncitizens on the state’s voter rolls.
Weber then complained about the federal government’s data sources and methodology and demanded to know how the agents obtained California’s registration list.
RedState noted, “And we already know California’s registration system has been exploited. … Former Lodi Councilman Shakir Khan pleaded no contest to 14 election fraud felonies related to the 2020 general election. Investigators found that he registered noncitizens living overseas, including his brother in Pakistan. San Joaquin County’s sheriff confirmed that a Pakistani citizen living in Pakistan voted in California’s 2020 election.”
