DOJ Report Exposes Biden White House Push to Target Parents — Internal Emails Set Off Revolt

A new Justice Department report says the Biden White House pushed federal law enforcement to find a way to go after parents who spoke out at school board meetings.

The internal resistance was fierce.

One DOJ official warned that the effort could become an “Anti-MAGA Task Force.” Others called it political, dangerous and a threat to the department’s reputation.

Those warnings did not stop then-Attorney General Merrick Garland from issuing the October 2021 memo that launched a federal response.

The Justice Department’s Civil Rights Division announced the findings Monday and made its new position plain: parents are not terrorists.

The report is the product of the DOJ’s Weaponization Working Group, created after President Trump ordered the federal government to identify and end political weaponization inside its own agencies.

The Justice Department says the White House and senior DOJ officials were looking for a federal “hook” that could be used against parents and school-board protesters even though attorneys and agents repeatedly warned that the underlying conduct was overwhelmingly local — and often protected by the First Amendment.

The spark was a September 2021 letter from the National School Boards Association to President Joe Biden. That letter suggested some confrontations at school board meetings could amount to domestic terrorism or hate crimes.

Five days later, Garland sent his memo to the FBI, the Criminal Division, U.S. Attorneys and other federal officials.

The review says Justice Department lawyers questioned whether the federal government had jurisdiction over many of the incidents being discussed. FBI personnel also warned that the proposed response could pull national-security resources into disputes that belonged with local authorities.

The new review says the evidence did not match the government’s rhetoric.

According to DOJ, officials had been shown very little evidence of actual violence or credible threats at school board meetings. Yet Garland’s memo declared there had been a “disturbing spike” in harassment, intimidation and threats of violence.

Inside the department, more than a dozen DOJ and FBI personnel objected.

Their messages were blunt. One official called the proposal “stupid, stupid, stupid.”

Another said there was “nothing remotely federal” about much of the conduct. Others warned that the plan looked partisan and entered “potentially dangerous ground” under the First Amendment.

The memo did more than generate angry emails.

The FBI opened 25 “Guardian assessments” tied to parents. The term refers to preliminary FBI reviews of tips that could involve terrorism-related threats.

One whistleblower said a mother was investigated in part because she owned a gun and belonged to what an FBI office described as a “right-wing mom’s group.”

The DOJ report also says six of the assessments were handled through the FBI’s Counterterrorism Division, 17 involved the Criminal Investigations Division and two involved the Weapons of Mass Destruction Directorate.

That is an extraordinary use of federal power against citizens whose supposed offense was speaking up about what was happening in their children’s schools.

The new Justice Department is now offering the people caught in those assessments a chance to see what the FBI collected about them.

DOJ says it will place a disclaimer on assessments connected to the Garland memo, review files for constitutional violations and issue formal apologies where violations are found. The department also says it will install internal controls aimed at preventing another political crackdown.

The response is not limited to looking backward.

The Justice Department and Department of Education sent a joint letter to all 50 state attorneys general affirming that federal privacy laws protect parents’ rights to know what is happening with their children at school.

The agencies also announced enforcement action against the Los Angeles Unified School District over policies that instruct employees to keep a student’s asserted gender identity private from parents.

The federal letter points to two laws. FERPA gives parents access and control rights over their children’s education records, while the Protection of Pupil Rights Amendment requires notice and parental consent before schools collect certain sensitive information from students.

DOJ says LAUSD employees were instructed to ask students privately how they wanted to be identified in communications with parents. The district’s policies also treated a student’s asserted gender identity as confidential information that could be withheld from the family.

Assistant Attorney General Harmeet Dhillon said her Civil Rights Division would stand with parents and enforce their rights under federal law.

House Republican Conference Chair Lisa McClain pointed directly to the most explosive internal warning in the report.

The verdict is in: Biden’s DOJ went after parents for speaking up at school board meetings. The DOJ’s own attorney said, “…they might as well rename the damn thing the Anti-MAGA Task Force.”

Garland’s memo was sold as a public-safety response.

The government’s own files now tell a different story: officials saw the constitutional danger, warned that the effort looked political and watched the White House keep pressing anyway.

Parents were right to demand answers then.

Now they are finally getting the receipts.
