Former FBI Director James Comey is facing another federal prosecution after the Justice Department brought new criminal charges against the longtime adversary of President Donald Trump, marking the latest chapter in a yearslong legal battle involving one of Washington’s most controversial former law enforcement officials.

The new case follows previous federal proceedings against Comey, including allegations involving his congressional testimony and a separate prosecution stemming from a social media post interpreted by investigators as a threat against Trump.

Comey responded to the latest development in a video posted to Instagram, declaring, “they’re back again,” before maintaining, “I’m still innocent.” His remarks came as questions emerged about the nature of the new prosecution and how it could affect his mounting legal troubles.

The latest charges come after federal investigators spent months examining Comey’s handling of sensitive government information. Prosecutors were pursuing a separate investigation into whether Comey improperly disclosed classified material, citing two people familiar with the matter.

The latest development also brings renewed attention to Comey’s involvement in the politically charged investigations surrounding the 2016 presidential election. As FBI director, Comey oversaw the bureau during its investigation into Hillary Clinton’s use of a private email server and the early stages of its inquiry into Russian election interference.

Comey previously faced federal charges in September 2025 for allegedly making false statements and obstructing a congressional proceeding. Prosecutors accused him of misleading lawmakers during testimony before the Senate Judiciary Committee in September 2020 concerning whether he had authorized an FBI official to serve as an anonymous source for news reporters.

That prosecution was dismissed after a federal judge determined that the prosecutor who obtained the indictment had been improperly appointed. Comey had pleaded not guilty and maintained that the case was politically motivated.

The former FBI director was subsequently indicted in April 2026 over an Instagram photograph showing seashells arranged to spell “8647.” Federal prosecutors alleged that the post constituted a threat against Trump, an interpretation Comey’s defense disputed.

Comey’s handling of internal FBI material has also been examined by the Justice Department’s inspector general. A 2019 investigation concluded that Comey violated bureau policies by providing an unclassified memorandum containing sensitive investigative information to a friend for disclosure to a reporter.

However, the inspector general’s findings did not establish that Comey knowingly leaked classified information to the media. The Justice Department declined to prosecute him over that episode.

Trump fired Comey in May 2017, setting off a political confrontation that continued long after the president’s first term. Comey subsequently became an outspoken Trump critic, while Trump repeatedly accused the former FBI director of misconduct and dishonesty.

The latest charges create another major legal confrontation between the Trump administration and the former head of the nation’s premier federal law enforcement agency.
