Just as the 2026 midterm elections are looming days from now, a Joe Biden-appointed federal judge born in Mexico has insisted that the Department of Homeland Security halt its investigations into possible fraudulent voting in nine states.
“A federal judge just restricted DHS election investigations in nine states. DHS agents are barred from conducting election-related field operations and interviews involving people who officials ‘know, suspect or should reasonably know or suspect are U.S. citizens,'” said the Epoch Times.
“The order covers California, Connecticut, Georgia, Missouri, Nevada, New York, Pennsylvania, Washington, and Wisconsin, and is set to last until after the polls close on Nov. 3. In the ruling, U.S. District Judge Araceli Martínez-Olguín said federal officers had insufficient time to review people suspected of illegally voting as noncitizens. She wrote that during the operation, officers were ordered to review at least 40 suspected subjects and had no more than 12 minutes to clear someone from the list using commercial databases. Those time limits, she said, raised the risk of mistakes. She also questioned the reliability of the target list itself, noting that even under ideal conditions, there is a high chance of error because no federal database contains the citizenship status of U.S. residents.”
According to a Fox News report, the judge claimed there were concerns over “voter intimidation.”
The judge, born in Mexico and holding a anti-border security record of decisions, before taking the bench was an advocate for “immigrants’ rights” with the leftist ACLU.
The Trump administration has worked hard on border security and election integrity, issues that are related given that many noncitizens have been found on state voter rolls, including in California where the federal government supplied the state with a list of 20,000 names on its voter rolls suspected of not being citizens. Officials in New Jersey right now are being investigated by Congress for putting the names of 6,600 noncitizens on their voter rolls.
The judge did not find investigating noncitizen voters illegal, but said DHS methods were likely dependent on unreliable data.
A commentary at RedState said, “Just hours after RedState’s Becky Noble reported on a new audit that examined the records of foreign-born federal judges – including one Biden appointee who was born in Mexico and was found to have ruled against border-enforcement policies an eye-popping 93 percent of the time – along comes that very same judge to hand the Trump administration yet another election integrity setback.”
It continued, “And the timing is certainly quite suspect, with the midterm elections being less than two weeks away.”
