The Federal Communications Commission may review language used by Fox Sports analyst Tom Brady during the network’s September 20 broadcast of the Dallas Cowboys’ 37-20 win over the Washington Commanders.
Brady, who is in his third season as a color commentator alongside play-by-play announcer Kevin Burkhardt, made two remarks that circulated widely afterward.
Near the end of the first half, Commanders quarterback Jayden Daniels suffered a dislocated left elbow after being stepped on while taking a snap. As Fox aired a replay showing the injury, Brady said, “Oh, sh**,” then immediately added, “Excuse me. I was not expecting to see that.”
In the fourth quarter, after Cowboys quarterback Dak Prescott completed a 35-yard sideline pass to CeeDee Lamb, Brady called the throw an “absolute piss missile up the sideline.”
Journalism professor Michael Socolow posted that the use of “sh**” on the live broadcast was “a violation of the F.C.C.’s indecency rules,” while noting that the status of “fleeting indecency” remains legally unsettled. FCC rules restrict obscene, indecent, and profane content on broadcast television from 6 a.m. to 10 p.m.
Statutory maximum forfeitures have been reported in the range of $325,000 to $508,000 per violation or per day, with higher caps for continuing violations; such penalties are customarily directed at the station licensee rather than the on-air talent.

Brady later discussed the comments in a Fox #AskTom segment. He described a “piss missile” as a pass thrown with maximum velocity and precision, detailing the mechanics he used as a player: ground-force production, body torque, and a relaxed arm.
“I fully expect you to beep out those ‘piss missiles,’ okay? You can’t say that, because that swear jar is getting way too full in my house. My kids are getting way too happy with me filling up that jar.” He added, “I’m actually kind of embarrassed. There’s a lot of grandmas at home that probably aren’t very happy with my mouth on Fox. I’m going to fix that. Sorry, I apologize.”
In a follow-up social media post, the legendary quarterback revealed that he received a call from the FCC about his commentary. “More miss pissles and a few turkey provolones no doubt coming up this year… yes, I meant miss pissles, I got a call from the FCC
As of this report, the FCC had issued no public confirmation of an investigation or enforcement action. Isolated, unscripted remarks during live sports telecasts have historically produced mixed outcomes under the fleeting-expletive standard.
