The former Minneapolis police officer who was convicted of murder in the death of drug addict George Floyd is moving to get the charges against him thrown out.
On Tuesday, Derek Chauvin’s attorneys filed a new motion to dismiss the case.
Chauvin’s lawyers are essentially arguing that the whole trial was a sham because a grand jury was never convened to review the evidence against their client.
They are also accusing Minnesota Gov. Tim Walz and Attorney General Keith Ellison of engaging in “illegal” and “fraudulent” conduct related to the trial.
Reporter Liz Collin explained:

BREAKING: Derek Chauvin’s attorney seeks dismissal in a new bombshell court filing alleging ‘illegal’ and ‘fraudulent’ conduct by Governor Tim Walz, Attorney General Keith Ellison, and the Hennepin County Attorney’s Office.
Chauvin’s attorney, Greg Joseph, argues a grand jury was never convened to review the charges.
“Because Hennepin County’s unlawful charges against Mr. Chauvin were not severe enough for the mob, Walz referred the case to Keith Ellison, who signed and e-filed a second unfounded complaint against Derek Chauvin that included the murder charge.”
More to come…
This isn’t the first time Chauvin’s defense has tried to get him freed.
But the allegations against Gov. Walz and AG Ellison are new — and, they’re
huge.
This might truly be the best chance at freedom for Derek Chauvin since he was locked up in 2021.
Minnesota Star Tribune reported further on the petition:
For the third time, Derek Chauvin has asked Minnesota courts to vacate his conviction for the murder of George Floyd.
Chauvin’s attorney Gregory Joseph filed the petition for postconviction relief on Aug. 18 in Hennepin County. State officials violated Chauvin’s right to due process, Joseph wrote in the petition, adding that the complaint leading to Chauvin’s conviction was “unlawful, unfounded, and illegitimate.”
The move revived criticism of the landmark trial and stirred conversations from citizens and business leaders like Tesla’s Elon Musk.
In the petition, Joseph argued that Gov. Tim Walz broke the law in reassigning authority of the case to Attorney General Keith Ellison’s office, making Ellison’s involvement illegitimate. The petition also claimed “there was no medical evidence to support the bogus theory of ‘asphyxia’ advanced by the state,” and that the Hennepin County District Court should have convened a grand jury before charging Chauvin.
If court officials deny the petition, Joseph asked that they grant an evidentiary court hearing about the case.
Derek Chauvin was sentenced to over 22 years in prison on state murder charges for the death of George Floyd — even though autopsy results showed that Floyd overdosed on fentanyl.
For reference:
Despite the evidence, Derek Chauvin has been rotting in prison for 5 years now on a murder conviction.
Now, we are finding out that his trial violated his constitutional rights to due process.
It should be overturned immediately.
One day after the petition to dismiss the conviction was filed, Elon Musk open called for Chauvin to be freed in a post on X.
Read his statement here:
Derek Chauvin was unjustly convicted of murder, therefore he should be freed.
The facts show that he was not the cause of death, nor did he at any time intend for a death to occur. Whatever else he may be, he is not a murderer.
That is the truth.
